A few days ago, the Ministry of Commerce and the General Administration of Customs issued a notice on the export control of "antimony and other items".
In accordance with the relevant provisions of the Export Control Law of the People's Republic of China, the Foreign Trade Law of the People's Republic of China and the Customs Law of the People's Republic of China, in order to safeguard national security and interests and fulfill international obligations such as non-proliferation, The State Council has approved the implementation of export control on the following items, which will come into effect on September 15, 2024.
1. Items that meet the following characteristics shall not be exported without permission:
(1) antimony related items
1. Antimony ore and raw materials, including but not limited to block, particle, powder, crystal and other forms. (Refer to Customs Code: 2617101000, 2617109001, 2617109090, 2830902000)
2. Metallic antimony and products, including but not limited to ingot, block, bead, particle, powder and other forms. (Refer to Customs commodity number: 8110101000, 8110102000, 8110200000, 8110900000)
3. Antimony oxide, purity greater than or equal to 99.99%, including but not limited to powder form. (Refer to Customs Commodity No. 2825800010)
4. Trimethyl antimony, triethyl antimony and other organic antimony compounds, purity (inorganic element basis) greater than 99.999%. (Refer to Customs commodity No. : 2931900032)
5. Hydrides of antimony with a purity greater than 99.999% (hydrides containing antimony diluted in inert gases or hydrogen). (Refer to Customs Commodity No. 2850009020)
6. Indium antimonide, having all of the following characteristics: single crystals with dislocation density less than 50 / cm2, and polycrystals with purity greater than 99.99999%, including but not limited to ingot (bar), block, sheet, target, particle, powder, scrap and other forms. (Refer to Customs commodity No. 2853909031)
7. Gold antimony smelting and separation technology.
(2) Items related to superhard materials
1. Six-sided top press equipment, having all the following characteristics: specially designed or manufactured X/Y/Z three-axis six-sided synchronous pressure large hydraulic press, cylinder diameter greater than or equal to 500 mm or designed to use pressure greater than or equal to 5 gigapascals. (Refer to Customs commodity number: 8479899956)
2. Key parts for six-sided top press, including hinge beam, top hammer, high pressure control system with synthetic pressure greater than 5 gigapascals. (Refer to Customs commodity number: 8479909020, 9032899094)
3. Microwave plasma chemical Vapor deposition (MPCVD) equipment having all of the following characteristics: Specially designed or manufactured MPCVD equipment with a microwave power of more than 10 kW and a microwave frequency of 915 MHZ or 2450 MHZ. (Refer to Customs commodity number: 8479899957)
4. Diamond window materials, including curved diamond window materials, or flat diamond window materials with all of the following characteristics: (1) single crystal or polycrystal with a diameter of 3 inches and above; (2) Visible light transmittance of 65% and above. (Refer to Customs commodity number: 7104911010)
5. Synthetic synthetic diamond single crystal or cubic boron nitride single crystal technology with six-sided top press.
6. Technology for the manufacture of six-sided top press equipment with listed tubes.

2. Export operators shall, in accordance with relevant provisions, go through the export licensing procedures, apply to the Ministry of Commerce through the provincial competent department of Commerce, fill in the application form for the export of dual-use items and technologies and submit the following documents:
(1) the original of the export contract or agreement or photocopies or scans consistent with the original; (2) Technical description or test report of the item to be exported; (3) End-user and end-use certificates; (4) Introduction of importers and end users; (5) the identity certificate of the applicant's legal representative, main business manager and handling person.
The Ministry of Commerce shall, from the date of receipt of the export application documents, examine them, or jointly examine them with relevant departments, and make a decision on approval or disapproval within the statutory time limit.
The export of the items listed in this announcement which have a major impact on national security shall be submitted to The State Council for approval by the Ministry of Commerce together with other relevant departments.
After examination and approval, the Ministry of Commerce shall issue the export license for dual-use items and technologies (hereinafter referred to as the export license).

6.An export operator shall present an export license to the Customs, complete customs formalities in accordance with the provisions of the Customs Law of the People's Republic of China, and accept customs control. The Customs shall go through the formalities for inspection and release on the basis of the export license issued by the Ministry of Commerce.
7. Where an exporter exports without permission, beyond the scope of the license or commits other illegal acts, the Ministry of Commerce, the Customs and other departments shall impose administrative penalties in accordance with the provisions of relevant laws and regulations. If the case constitutes a crime, criminal responsibility shall be investigated according to law.
