The declaration is inconsistent! No penalty?
Recently, a Guangzhou technology company declared a batch of imported goods to Huangpu New Port Customs under Huangpu Customs in the form of bonded maintenance trade, and the declared packaging type was "other packaging/paper or fiberboard boxes/boxes". Customs officers found that the actual packaging of the goods was natural wooden pallets, which was inconsistent with the company's declaration.
After further investigation by the customs, it was found that although the wooden packaging was not inspected as required, it had been affixed with a valid International Plant Protection Convention (IPPC) special mark and there was no abnormality after quarantine. According to the "First Violation Exemption from Punishment" list clause of the "Customs Administrative Penalty Discretion Criteria (II)" implemented on March 1, Huangpu Customs made a decision not to impose administrative penalties on the company, replacing traditional penalties with education and rectification, becoming the first case in the country after the implementation of the new regulations.
The new regulations clearly state that if the company has no record of violations in the same field within 24 months, the violations have not caused substantial harm and have been rectified in a timely manner, the customs can exempt penalties for 10 types of minor violations, covering common problems such as packaging declaration defects and document content errors and omissions.
Sunny worldwide logistics have more than 26 years of freight forwarding history, and over half of staffs working in Sunny about 5-13years. Sunny Worldwide Logistics is not a small freight forwarding workshop, owning 1800 square meters A-class office. Highly attention on the shipment more than the owner, site supervising and real-time tracking feedback.
The policy adjustment reflects the deep transformation of customs supervision thinking. Punishment is not the goal. Only by educating and guiding enterprises to establish a long-term compliance mechanism can the unity of legal and social effects be achieved. The person in charge of the enterprise involved admitted that flexible handling avoided the impact of fines on cash flow, and at the same time forced enterprises to enhance compliance awareness, establish a long-term compliance mechanism, and achieve healthy development. This closed-loop mechanism of "tolerance-rectification-improvement" not only reduces the burden and alleviates difficulties for foreign trade enterprises, but also strengthens compliance awareness through source governance.
